These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and MaxDex Services ("Company", "we", "us", "our"), an entity registered in Victoria, Australia. By downloading, installing, accessing, or using the MaxDex mobile application (the "Service" or the "App"), you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately cease using the App and delete it from your device. Continued use of the App after any modification to these Terms constitutes your acceptance of the revised Terms. We will endeavour to notify users of material changes where reasonably practicable.

You must be at least 16 years of age to use this Service. If you are under the age of 18, you represent that you have obtained parental or guardian consent to use this Service.

MaxDex is a personal productivity and wellness application that utilises artificial intelligence to assist users in managing their health metrics, setting and achieving personal goals, scheduling daily activities, and receiving personalised coaching feedback. The App operates using a combination of on-device sensor data processing and cloud-based AI services.

The specific features of the App include, but are not limited to: AI-powered voice coaching calls (Morning Briefing and Evening Debrief), text-based AI chat (powered by Google Gemini), step tracking via device accelerometers, sleep monitoring via motion detection, screen time monitoring via Android UsageStats, calorie and meal logging via AI image analysis, AI-generated goal roadmaps, and a personalised daily planner.

Important Disclaimer: The artificial intelligence systems embedded within the App — including Max (the AI assistant), Morning Briefing, Evening Debrief, Goal Chat, and the Roadmap generator — generate informational and motivational content for general personal development purposes only.

AI-generated content provided through the App does not constitute, and must not be relied upon as, medical advice, psychological or psychiatric advice, nutritional advice, financial advice, legal advice, or any other form of professional advice. The Company makes no representations as to the clinical accuracy, completeness, or suitability of any AI-generated response for any particular purpose.

You are solely responsible for decisions you make based on information or recommendations received through the App. If you have or suspect you have a medical, psychological, or other health condition, you must consult a qualified healthcare professional before making any changes to your lifestyle, diet, or treatment plan.

Access to certain premium features of the App requires a paid subscription (the "MaxDex Pro" subscription). Subscriptions are offered on a monthly or annual basis and are processed exclusively through Google Play Billing. The Company does not directly process, store, or have access to your payment card information.

Subscription fees are charged to your Google Play account at the time of purchase and automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date. You may manage and cancel your subscription at any time through your Google Play account settings.

Refund requests are governed by the Google Play Store refund policy. The Company is unable to independently process refunds for purchases made through Google Play. The Company reserves the right to modify subscription pricing at any time. Price changes will be communicated in advance and will take effect at the next renewal cycle.

By using the Service, you agree that you will not:

(a) Use the Service for any unlawful purpose or in violation of any applicable laws or regulations; (b) Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App; (c) Introduce malicious code, viruses, or any software intended to damage or interfere with the proper functioning of the Service; (d) Use automated scripts, bots, or crawlers to interact with the Service.

All content, features, functionality, design, graphics, software, and underlying intellectual property within the App are the exclusive property of MaxDex Services or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the App or its content beyond the limited right to use it as set forth herein.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAXDEX SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law principles. You agree that any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.
